2. Subscriptions and Refunds

SUBSCRIPTIONS: In addition to offering a Customer Application (free), we offer paid subscriptions. Please see our subscription pages for current features and pricing. Features and prices are subject to change. Additional terms and conditions (to be shown prior to purchase) apply to custom accounts. All fees may be subject to taxes.

CANCELLATION AND REFUNDS: Both the client and 5iQ have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, as all subscription products are non refundable. By default, all subscriptions are set to automatically renew for the same period of time as the original subscription. You may decline to renew at any time prior to the commencement of a renewal subscription if you give 5iQ written notice within thirty (30) days of your monthly subscription renewal date, and within sixty (60) days of yearly subscription renewal date. After the cancellation period ends, all purchases are final and all fees paid are non-refundable, even if your account is later terminated by 5iQ. If your account is terminated due to your breach of this Agreement during the relevant cancellation period, you will not be refunded. 5iQ Pty Ltd is not responsible for storing or continuing to house data, information or provide any service once the client has terminated. Data may be extracted, there may be fees for data extraction at reasonable commercial rates. If you have questions, please contact us.

3. Disclaimer Exclusions and Limitations

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company: 5iQ Pty Ltd excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Companies literature; and excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages. This Company does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. Whilst 5iQ provides services that should be available 24 hours a day, seven days a week, it is possible that on occasion the Services or Website may be unavailable to permit maintenance or other development activity to take place. By using any of 5iQ’s services you thereby indemnify this company, its employees agents and affiliates against any loss or damage of data, in whatever manner howsoever caused.

5. Log Files

We use IP addresses to analyse trends, administer the site, track users movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.
